Terms of Service
The short version. Fizz Cam is licensed to you, not sold. The photos you take are yours. Subscriptions are billed and cancelled through Apple. Your captures live on your device, so keep your own backups.
These Terms are an agreement between you and Vidtory Technology, trading as Vidtory Labs ("we", "us"), covering your use of the Fizz Cam iOS app and this website (together, "the Service"). By downloading or using the app you accept these Terms. If you do not accept them, do not use the app.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Fizz Cam on Apple devices that you own or control, in line with the App Store Terms of Service. You may not copy, sell, rent, sublicense, reverse-engineer, decompile or attempt to extract the source code or the film-rendering assets of the app, except to the extent that applicable law expressly permits it.
2. Your content
The photos, videos and camera looks you create with Fizz Cam are yours. We claim no ownership of them and no licence over them. Because the app has no servers, we never receive them.
You are responsible for what you shoot and for having the rights to any material you import into the app — including LUTs, look files and photos created by someone else. Do not use Fizz Cam to record people without the consent required where you are, or in any way that breaks the law.
3. Purchases and subscriptions
Fizz Cam may offer optional paid features, sold as an auto-renewing subscription or a one-time purchase.
- Billing. Payment is charged to your Apple Account at confirmation of purchase. Prices are shown in the app in your storefront's currency and may differ by region.
- Renewal. A subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Free trial. If a free trial is offered, it converts into a paid subscription at the end of the trial unless you cancel before it ends. Any unused part of a trial is forfeited when you buy a subscription.
- Managing and cancelling. You manage and cancel subscriptions in your Apple Account settings on your device — not in the app. Deleting the app does not cancel a subscription.
- Refunds. Purchases are handled by Apple, so refunds are governed by Apple's policy and requested through Apple. We cannot issue refunds for App Store transactions.
- Lifetime purchases cover the Fizz Cam app for as long as we offer it on the App Store. They do not entitle you to a separate future app or a paid successor product.
4. Your device and your files
Fizz Cam stores your captures on your device. Deleting the app, deleting a capture, or enabling the optional RAW retention window removes files permanently, and we cannot recover them for you. Keep your own backups of anything you care about, and save important shots to your Photos library.
5. Availability, updates and requirements
Fizz Cam requires iOS 17 or later. Some features depend on your hardware — certain capture formats and lenses are only available on devices that support them. We may change, update or discontinue features, and we do not promise that the Service will be uninterrupted or error-free.
6. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be free of defects, that it will work with every device or iOS version, or that captures will always be processed or saved without error.
7. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, photos, profits or goodwill, arising from your use of the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the app in the 12 months before the claim, or to the minimum permitted by applicable law if that is greater. Some jurisdictions do not allow these limitations, in which case they apply to you only as far as the law allows.
8. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your licence if you materially breach these Terms. Sections 2, 6, 7 and 10 survive termination.
9. Apple
Apple is not a party to these Terms and has no responsibility for the app or its content. Apple has no obligation to provide maintenance or support for Fizz Cam. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Changes and governing law
We may update these Terms; the revised version takes effect when posted here, with the date at the top updated. Continuing to use the app after a change means you accept it. These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules, and without depriving you of the protection of mandatory consumer law where you live.
